1. Purpose and Acceptance
These Terms and Conditions of Use (hereinafter, “Terms”) govern access to and use of the DayMood mobile application (hereinafter, “the Application” or “the App”), developed and managed by Jaime López Muñoz (hereinafter, “the Developer”).
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with any of the conditions, you must not use the Application.
Important: These Terms should be read together with our Privacy Policy, which forms an integral part of this agreement.
2. Service Description
DayMood is an emotional journal application available on iOS (Apple App Store) and Android (Google Play Store) that allows users to:
- Create and store personal diary entries
- Receive automated emotional analysis using artificial intelligence
- View emotional patterns and wellness statistics
- Manage and export their personal data
The emotional analysis is based on the clinical model of Plutchik’s Wheel of Emotions and uses artificial intelligence technology (Google Gemini 2.5 Pro as the primary provider and OpenAI GPT-4o as backup, in accordance with their respective terms of service) to identify emotions, their intensity, and possible triggers.
IMPORTANT — AI Limitations and Mental Health Disclaimer:
DayMood is NOT a medical device and does NOT provide medical or psychological diagnoses, advice, or treatment. The emotional analysis provided by the AI is for personal self-awareness and guidance purposes only. The AI may produce inaccurate, incomplete, or inconsistent results. You should never rely on DayMood’s analysis as a substitute for professional psychological or medical advice.
If you experience mental health issues, depression, anxiety, suicidal thoughts, or any other condition, please consult a qualified mental health professional immediately.
In case of emergency or mental health crisis, immediately contact emergency services (112 in Europe, 911 in the USA) or crisis helplines in your country.
3. License Grant (End User License Agreement)
3.1 License
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on any compatible device that you own or control, solely for your personal, non-commercial purposes.
3.2 License Restrictions
You may not:
- Distribute, sublicense, lease, lend, or otherwise transfer the Application or any rights therein to any third party
- Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the Application, except to the extent permitted by applicable law
- Remove, alter, or obscure any proprietary notices in the Application
- Use the Application for any commercial purpose without the Developer’s prior written consent
3.3 Termination of License
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies from your devices.
4. Subscriptions and Payments
4.1 Service Tiers
DayMood offers two service tiers:
- Free Tier: Basic access with limited daily emotion analyses and ads (served by Google AdMob).
- DayMood Premium: Full access to all features, unlimited analyses, no ads, and additional capabilities such as diary search and data export.
4.2 Subscription Plans
DayMood Premium is available as an auto-renewable subscription through the following plans:
- Monthly: Billed monthly at the price displayed at the time of purchase.
- Annual: Billed annually at the price displayed at the time of purchase.
Both plans may include a free trial period. After the trial ends, you will be charged unless you cancel at least 24 hours before the trial expires.
4.3 Billing and Renewal
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
On Android (Google Play):
- Payment is processed through Google Play.
- Your Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- Prices may vary by region and are displayed in your local currency.
- You can manage or cancel your subscription at any time through Google Play Settings > Subscriptions.
On iOS (Apple App Store):
- Payment is processed through Apple App Store via your Apple ID.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- Prices may vary by region and are displayed in your local currency.
- You can manage or cancel your subscription at any time through Settings > [your name] > Subscriptions on your iOS device.
Cancellation on either platform takes effect at the end of the current billing period. You retain access to Premium features until that date.
4.4 Refunds
Refund requests are handled by the respective platform in accordance with their refund policies:
- Android: Refunds are handled by Google Play in accordance with Google Play’s refund policy. You may request a refund through the Google Play Store or by contacting Google Play Support.
- iOS: Refunds are handled by Apple in accordance with Apple’s refund policy. You may request a refund through Apple’s “Report a Problem” page or by contacting Apple Support.
The Developer does not process refunds directly on either platform.
4.5 Price Changes
We reserve the right to modify subscription prices. Any price change will be communicated in advance through the respective app store and will apply from the next billing cycle. You will have the option to cancel before the new price takes effect.
4.6 Free Trial
If a free trial is offered:
- It is available only once per Apple ID (iOS) or Google account (Android).
- If you do not cancel before the trial ends, your subscription will begin and you will be charged.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
5. Usage Requirements
5.1 Minimum Age
The Application is intended exclusively for users aged 16 and over.
By using DayMood, you represent and warrant that you are at least 16 years old. If you are under 16, you must not use this Application.
5.2 User Account
To use DayMood you need:
- Android: A valid Google account for sign-in
- iOS: A valid Apple, Google, or Email/Password account for sign-in
- A compatible device:
- Android: Android 10 or higher (API 29+)
- iOS: iOS 17.0 or higher
- Internet connection to sync data and perform emotional analysis
5.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Keep your login credentials secure and not share them with third parties
- Notify us immediately at daymood@jaimelxpez.com if you suspect unauthorized access to your account
- Understand that your end-to-end encryption key is derived from your account; losing access to your account may result in loss of access to your encrypted diary content
5.4 Accuracy of Information
You agree to provide accurate information and to keep your account information up to date.
5.5 Technical Requirements and Integrity Verification
To ensure service security, DayMood implements integrity verification measures:
- The Application uses Firebase App Check to verify that requests come from a legitimate version of the application:
- Android: Play Integrity API
- iOS: App Attest / DeviceCheck
- Devices that do not pass integrity checks may have limited functionality or may not be able to access the service
- Devices with modified operating systems (root on Android / jailbreak on iOS) or altered applications may not work correctly
These measures protect both your data and the service infrastructure from unauthorized access.
6. Permitted Use
The Application must be used only for:
- Personal emotional tracking and monitoring
- Self-awareness and personal reflection
- Analysis of your own emotional patterns
You agree to use the Application responsibly, legally, and in accordance with these Terms.
7. Prohibited Use
The following is expressly prohibited:
- Using the Application for illegal or unauthorized purposes
- Entering content that incites hatred, violence, or discrimination
- Attempting to access other users’ accounts
- Reverse engineering, decompiling, or modifying the Application (except as permitted by applicable law)
- Using the Application to collect third-party data
- Interfering with the normal operation of the Application
- Using the Application for unauthorized commercial activities
- Circumventing implemented security measures, including integrity verification (App Check)
- Attempting to access backend services without going through the official application
Violation of these prohibitions may result in suspension or cancellation of your account.
8. Intellectual Property
8.1 Application Ownership
The Application, including its source code, design, graphics, logos, and other elements, is the exclusive property of the Developer and is protected by Spanish and international intellectual property laws.
8.2 User Content
You retain full ownership of all content you enter into the Application (diary entries, texts, etc.). By using the Application, you grant us a limited, non-exclusive, and revocable license solely to:
- Store your content on our servers (in encrypted form)
- Process your content to provide the emotional analysis service (by sending it to the AI providers described in Section 2)
- Display your content to you within the Application
This license is granted solely for the purpose of providing the DayMood service to you. We will not use your content for any other purpose. This license terminates when you delete your content or your account.
9. End-to-End Encryption and Data Security
9.1 Encryption
DayMood protects the sensitive content of your diary entries with end-to-end encryption (AES-256-GCM with 256-bit keys). This means:
- The text of your entries is encrypted before leaving your device
- Your data is stored encrypted on our servers
- Your encryption key is derived from your account and stored securely on your device
9.2 User Responsibility
You acknowledge and accept that:
- Losing access to your account may result in loss of access to your encrypted data
- You are responsible for maintaining the security of your device and account
- The Developer cannot recover encrypted content if you lose your encryption key or account access
- You should ensure your device is secured with appropriate screen locks and security measures
10. Third-Party Services and Data Processing
DayMood relies on third-party service providers to deliver its core features. By using the Application, you acknowledge that:
- Google Gemini (primary AI provider) may retain your diary entry text for up to 30 days in accordance with Google’s terms of service for the Gemini API.
- OpenAI GPT-4o (backup AI provider) may retain your diary entry text for up to 30 days in accordance with OpenAI’s API data usage policy.
- Firebase Crashlytics retains crash data for 90 days in accordance with Google’s data retention policies.
- Firebase Performance retains performance metrics for 90 days in accordance with Google’s data retention policies.
- Google Play and Apple App Store process payment and subscription data in accordance with their respective terms of service.
- Google AdMob processes advertising data in accordance with Google’s privacy policy (free tier only).

11. Limitation of Liability
11.1 Mental Health Disclaimer
IMPORTANT: DayMood is NOT a substitute for professional psychological or medical advice, diagnosis, or treatment.
The emotional analysis provided by the Application is generated by artificial intelligence and is merely indicative. It is intended solely for personal self-awareness purposes and has significant limitations:
- The AI may produce inaccurate, incomplete, or contradictory emotional assessments
- Emotional analysis is inherently subjective and cannot capture the full complexity of human emotions
- The results should not be used to self-diagnose any mental health condition
- DayMood does not monitor your wellbeing and cannot detect mental health crises
If you experience mental health issues, depression, anxiety, suicidal thoughts, or other conditions, you should consult with a qualified mental health professional.
In case of emergency or mental health crisis, immediately contact emergency services (112 in Europe, 911 in the USA) or crisis helplines in your country.
11.2 General Limitation
To the maximum extent permitted by applicable law:
- The Application is provided “as is” and “as available”
- We do not guarantee that the Application will be error-free or uninterrupted
- We do not guarantee the accuracy or precision of the emotional analysis
- We shall not be liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the service in the 12 months preceding the claim
11.3 Service Availability
We do not guarantee continuous and uninterrupted availability of the Application. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control.
12. Disclaimer of Warranties
Except as expressly stated in these Terms, the Developer makes no warranties, express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement of third-party rights
- Results derived from the use of the Application
- Accuracy, reliability, or completeness of the AI-generated emotional analysis
13. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from:
- Your use of the Application
- Your breach of these Terms
- Your violation of third-party rights
- Content you enter into the Application
14. Termination
14.1 By the User
You may stop using the Application at any time and delete your account from the “Profile” section > “Delete account”. When you delete your account, all your data will be deleted from our servers.
If you have an active Premium subscription, canceling your account does not automatically cancel your subscription. You must cancel your subscription through the respective platform before deleting your account to avoid further charges:
- Android: Google Play Settings > Subscriptions
- iOS: Settings > [your name] > Subscriptions
14.2 By the Developer
We reserve the right to suspend or terminate your access to the Application:
- If you breach these Terms
- If we detect fraudulent or abusive use
- By legal requirement
- If we decide to discontinue the service (with reasonable notice)
14.3 Effects of Termination
Upon termination:
- Your license to use the Application is revoked immediately
- You must cease all use of the Application and delete all copies from your devices
- We will delete your account data from our servers (subject to third-party data retention policies described in Section 10 and legal retention obligations)
- Provisions that by their nature should survive (intellectual property, limitation of liability, indemnification, governing law) shall remain in effect
15. Supported Platforms
DayMood is available on the following platforms:
- Android: Available on Google Play Store (requires Android 10 or higher)
- iOS: Available on Apple App Store (requires iOS 17.0 or higher)
Both platforms share the same Firebase database, allowing users to access their data from any compatible device. These Terms of Use apply to all versions of the application, regardless of the platform used.
16. Modifications
We reserve the right to modify these Terms at any time. In case of substantial changes:
- We will update the “last updated” date
- We may notify you through the Application
- Continued use after modification implies your acceptance
If you do not agree with the new terms, you must stop using the Application.
17. Governing Law and Jurisdiction
These Terms are governed by Spanish law and, in particular, by Regulation (EU) 2016/679 (GDPR) for matters related to the protection of personal data.
For the resolution of any dispute arising from these Terms or the use of the Application, the parties submit to the Courts and Tribunals of the user’s city of residence in Spain, unless consumer regulations establish another jurisdiction.

18. General Provisions
18.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of the Application.
18.2 Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18.3 Waiver
Failure to exercise any right under these Terms shall not constitute a waiver of such right.
18.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. The Developer may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets, upon notice to you.
